Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the DreamJournal.ai website, mobile application, and related services (the “Service”) operated by DreamJournal.ai (“we,” “us,” or “our”). By creating an account or using the Service, you agree to be bound by these Terms.

If you do not agree to these Terms, do not use the Service.

1. Acceptance of Terms

By creating an account, joining the waitlist, or otherwise accessing the Service, you confirm that you are at least 16 years old and agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference.

We use a sign-in-wrap model: by creating an account, you acknowledge that you have read and agree to these Terms.

2. Definitions

• “Service” — the DreamJournal.ai website, mobile application, API, and all related features and tools.
• “User,” “you” — the individual accessing or using the Service.
• “Content” — all text, images, audio, drawings, data, and other materials.
• “User Content” — Content created, uploaded, or shared by you, including dream entries, audio recordings, drawings, and chat messages.
• “Lucy” — our AI dream assistant that analyzes dreams and provides conversational responses.
• “Subscription” — a recurring paid access plan (Starter or Pro tier).

3. Account Terms

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the confidentiality of your account credentials.
• You may not share your account or allow others to access it.
• You must be at least 16 years old to use the Service.
• You are responsible for all activity that occurs under your account.
• We reserve the right to suspend or terminate accounts that violate these Terms.

4. Acceptable Use Policy

You agree not to use the Service to:

• Engage in or facilitate any illegal activity.
• Harass, threaten, or abuse other users or our staff.
• Upload content that infringes on third-party intellectual property rights.
• Distribute malware, viruses, or harmful code.
• Attempt to gain unauthorized access to the Service, other accounts, or our systems.
• Circumvent security measures, rate limits, or access controls.
• Scrape, data mine, or use automated means to access the Service beyond permitted usage.
• Send spam or unsolicited communications through the Service.
• Impersonate any person or entity.
• Use the Service to build a competing product.

We may take enforcement actions including warning, content removal, temporary suspension, or permanent termination of your account.

Fair use and service limits. Some features carry a per-use compute cost, including Lucy chat, voice transcription, and AI dream paintings. These are provided under a fair-use allowance that varies by plan and that we may set, adjust, or reset from time to time. Storing your own dream entries (text, voice, and sketch) is not capped for genuine personal use, but it remains subject to these fair-use terms. If an allowance is exceeded, or where use is abusive, automated, commercial, or otherwise outside the intended personal use of the Service, we may apply rate limits, throttling, slower or lower-priority processing, reduced model strength, suspension of the affected feature, or termination of your account.

No availability guarantee. We do not guarantee that the Service, or any feature (including any AI feature), will be available at all times, without interruption, at any particular speed, or with any particular model. Allowances, models, features, and performance may change as described above.

5. Intellectual Property

The Service, including its design, features, branding, trademarks, logos, and all underlying technology, is owned by DreamJournal.ai or its licensors. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms.

You may not:

• Reverse engineer, decompile, or disassemble any part of the Service.
• Copy, modify, or create derivative works of the Service.
• Use our trademarks or branding without prior written consent.

Any suggestions or feedback you provide may be used by us without obligation or compensation.

6. User Content and License

You retain ownership of your User Content. By using the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, process, store, and display your User Content solely for the purpose of operating, providing, and improving the Service.

This license is:

• Limited to what is necessary to provide the Service (including AI analysis, search, and pattern detection).
• Sublicensable only to our service providers who help operate the Service.
• Terminated when you delete your Content or your account, except where retention is required by law.

You represent that:

• You have the right to share the Content you upload.
• Your Content does not violate any third-party rights.
• Your Content complies with these Terms and applicable law.

We reserve the right to remove Content that violates these Terms.

7. AI-Generated Content

Lucy and other AI features generate analysis, insights, and responses based on your dream content. AI-generated outputs are provided for informational and reflective purposes only. They do not constitute medical, psychological, therapeutic, or professional advice.

We do not guarantee the accuracy, completeness, or usefulness of AI-generated content. You should not rely on it as a substitute for professional guidance.

8. Payment and Billing

DreamJournal.ai offers free and paid subscription tiers. Paid subscriptions are processed by Gumroad. Subscriptions started before we switched to Gumroad may still be processed by LemonSqueezy. By subscribing, you agree to the applicable payment processor’s terms of service.

• Billing cycle: subscriptions are billed monthly or annually, depending on the plan selected.
• Auto-renewal: subscriptions automatically renew at the end of each billing period at the then-current rate unless you cancel before the renewal date.
• Cancellation: you may cancel at any time from Settings > Billing in the app. If your subscription was purchased through the Apple App Store or Google Play, cancel it from that store’s subscription settings instead. Cancellation takes effect at the end of the current billing period.
• Taxes: you are responsible for all applicable taxes unless otherwise stated.
• Refunds: refund requests may be submitted within 14 days of purchase.

9. Limitation of Liability

To the maximum extent permitted by applicable law, DreamJournal.ai shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or business opportunities arising from your use of the Service.

Our total aggregate liability for all claims related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or EUR 100, whichever is greater.

These limitations do not apply to liability arising from our willful misconduct or gross negligence, or where such limitation is prohibited by applicable law. Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law, including EU consumer protection law.

10. Warranties and Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted operation.

We do not warrant that:

• The Service will be available at all times or free from errors.
• AI-generated content will be accurate, complete, or reliable.
• The Service will be secure or free from vulnerabilities.
• Dream analysis or insights will be therapeutically or scientifically valid.

Applicable law may not allow the exclusion of certain warranties. In such cases, limitations apply to the fullest extent permitted.

11. Indemnification

You agree to indemnify and hold harmless DreamJournal.ai and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from:

• Your violation of these Terms.
• Your User Content.
• Your use of the Service.
• Your violation of any third-party rights.

We will provide prompt notice of any claim and reasonable cooperation in its defense.

12. Dispute Resolution

We aim to resolve disputes amicably. If a dispute arises, please contact us at legal@dreamjournal.ai first. We will try to resolve it informally within 30 days.

If informal resolution fails, disputes shall be submitted to the competent courts. Nothing in these Terms limits your right to bring proceedings in the courts of your country of residence if you are an EU consumer, or to use any applicable alternative dispute resolution (ADR) procedure.

EU consumers may also lodge complaints via the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

13. Termination

• By you: you may close your account at any time through your profile settings or by contacting us.
• By us: we may suspend or terminate your account for breach of these Terms, with or without notice depending on severity.
• Effect: upon termination, your access ceases. You may request export of your data within 30 days of termination.
• Data retention: we will handle your data in accordance with our Privacy Policy.
• Service discontinuation: We may modify, suspend, or discontinue the Service, in whole or in part, at any time, including where the Service is no longer commercially viable for us to operate. If we discontinue the Service entirely, we will use reasonable efforts to give you advance notice and to keep the Service (or a tool to export your data) available for a reasonable period beforehand, so that you can retrieve your User Content before the Service is shut down.
• Surviving provisions: Sections 5 (IP), 6 (User Content License), 9 (Liability), 10 (Disclaimers), 11 (Indemnification), 12 (Disputes), and 14 (Governing Law) survive termination.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the Netherlands, without regard to conflict-of-laws principles. Nothing in these Terms limits any consumer protection rights that cannot be waived under applicable law.

15. Modifications to Terms

We may update these Terms from time to time. We will notify you of material changes by email or through a prominent notice in the Service at least 30 days before changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.

Where required by law, we will seek your affirmative consent for material changes.

16. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, severed from these Terms. The remaining provisions shall continue in full force and effect.

17. Entire Agreement

These Terms, together with the Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and DreamJournal.ai regarding your use of the Service. They supersede all prior or contemporaneous communications, proposals, and agreements, whether oral or written.
